The Viral Group Ltd (Company No. 12295038, trading as HYPD Live) (“HYPD”, “we”, “us”, “our”) operates the HYPD Live website at hypd.live and The Hub by HYPD community gaming platform at hypd.live/the_hub.
The Viral Group Ltd (Company No. 12295038, trading as HYPD Live) is a company registered in England and Wales. Our contact details are set out in Section 18.
References to “you” or “user” mean any person who accesses or uses our website or platform, whether as a visitor or registered account holder.
Acceptance of Terms
By accessing or using hypd.live or The Hub platform, you confirm that:
- You have read and understood these Terms & Conditions in full
- You agree to be bound by these terms and our Privacy Policy
- You have the legal capacity to enter into a binding agreement
- If you are using our services on behalf of a business or organisation, you have the authority to bind that entity to these terms
If you do not agree to these terms, you must not use our website or platform. Continued use of our services after any update to these terms constitutes acceptance of the revised terms.
The Hub by HYPD Platform
The Hub by HYPD is a gamer-focused social community platform operated as part of the HYPD Live services. The Hub provides registered members with access to:
- Community forums, discussion boards, and social features
- Member profiles and networking functionality
- Gaming news, articles, and community content
- Tournament and event registration
- Content submission and sharing features
- Any additional features added from time to time
The Hub is powered by BuddyBoss and WordPress. By registering for The Hub, you agree to these Terms & Conditions in addition to any platform-specific rules communicated to you on registration.
The Hub is a community platform. We aim to foster an inclusive, respectful, and welcoming environment for all gamers regardless of background, ability, or skill level. Behaviour that undermines this aim may result in removal from the platform.
Eligibility & Age Requirements
Our services are intended for users aged 13 and over. By using our services, you confirm that you meet this age requirement.
Users aged 13–17 (minors) must have obtained consent from a parent or legal guardian before registering for The Hub or entering any tournaments or events.
Certain events, tournaments, or content may have higher age requirements. Where this applies, we will state clearly at the point of registration. HYPD reserves the right to verify age and to terminate accounts where age requirements are not met.
The Viral Group Ltd (Company No. 12295038, trading as HYPD Live) does not knowingly collect personal data from children under 13. See our Privacy Policy for further details.
User Accounts
5.1 Registration
To access certain features of The Hub, you must register for a free account. You agree to provide accurate, current, and complete information during registration and to keep your details up to date.
5.2 Account security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately at enquiries@hypd.live if you suspect unauthorised access to your account
HYPD will not be liable for any loss or damage arising from your failure to maintain account security.
5.3 One account per person
You may only register one account per person. Creating multiple accounts to evade bans, manipulate tournaments, or circumvent platform rules is prohibited and may result in permanent removal.
5.4 Account deletion
You may request deletion of your account at any time by contacting us at enquiries@hypd.live. See our Privacy Policy for details on what happens to your data upon deletion.
Acceptable Use
You agree to use HYPD Live and The Hub only for lawful purposes and in a manner consistent with these terms. You must not:
6.1 Prohibited conduct
- Post, share, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or discriminatory on any basis including race, gender, sexual orientation, disability, religion, or nationality
- Bully, intimidate, stalk, or harass other users
- Impersonate any person or entity, or falsely represent your affiliation with any person or organisation
- Share another person’s personal information without their consent (doxxing)
- Upload or transmit viruses, malware, or any malicious code
- Attempt to gain unauthorised access to our systems, other accounts, or connected networks
- Scrape, crawl, or systematically extract data from our platform without our written consent
- Use automated bots or scripts to interact with the platform
- Engage in cheating, exploiting bugs, or use of unauthorised third-party software in tournaments
- Spam other users or post repetitive, irrelevant, or commercial content
- Post content that infringes any third party’s intellectual property rights
- Use our platform for any commercial purpose without our prior written consent
6.2 Consequences of breach
Breach of acceptable use may result in, at HYPD’s sole discretion: content removal, temporary suspension, permanent account termination, notification to law enforcement where appropriate, and/or legal action.
User-Generated Content
7.1 Your content
You retain ownership of any content you post on The Hub or submit to HYPD (“User Content”), including posts, comments, gaming clips, images, and profile information.
7.2 Licence to HYPD
By posting or submitting User Content, you grant The Viral Group Ltd (Company No. 12295038, trading as HYPD Live) a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that content across our platform and associated social media channels (Twitch, TikTok, Facebook, Instagram, YouTube) for the purpose of operating and promoting the HYPD community.
This licence allows us to feature your submitted gaming clips, highlights, and community content across our network as described in our service.
7.3 Your representations
By submitting User Content, you represent and warrant that:
- You own the content or have the right to submit it
- The content does not infringe any third party’s intellectual property rights
- The content does not contain material that is unlawful, defamatory, or in breach of these terms
- You have obtained all necessary consents from individuals identifiable in the content
7.4 Content moderation
HYPD reserves the right (but has no obligation) to review, edit, or remove any User Content at our discretion, including content that breaches these terms or that we consider inappropriate for our community.
Intellectual Property
8.1 HYPD’s intellectual property
All intellectual property rights in the HYPD Live website, The Hub platform, branding (including the HYPD name, logos, and design system), content created by HYPD, and all underlying technology are owned by or licensed to The Viral Group Ltd (Company No. 12295038, trading as HYPD Live).
Nothing in these terms grants you any right, title, or interest in HYPD’s intellectual property.
8.2 Restricted use
You may not, without our prior written consent:
- Copy, reproduce, distribute, or create derivative works based on HYPD’s content or brand assets
- Use the HYPD name, logo, or any trade marks in any way that implies endorsement or association
- Reverse engineer, decompile, or attempt to extract the source code of our platform
8.3 Copyright infringement
If you believe any content on our platform infringes your copyright, please contact us at enquiries@hypd.live with details of the allegedly infringing content and your ownership claim.
Tournaments, Events & Competitions
9.1 Participation
Entry to HYPD tournaments and events is subject to these Terms & Conditions plus any specific tournament rules published at the time of registration. Tournament rules take precedence over these general terms in the event of conflict.
9.2 Eligibility
To participate in HYPD tournaments you must:
- Hold a valid, active The Hub account
- Meet any age requirements specified for the event
- Agree to the specific tournament rules
- Not be subject to any current ban or suspension from HYPD services
9.3 Fair play
All participants must compete fairly and in the spirit of the game. The following are strictly prohibited:
- Cheating, hacking, or use of exploits, mods, or unauthorised third-party software
- Boosting, match-fixing, or deliberately manipulating results
- Impersonating another player
- Abusive or unsportsmanlike behaviour toward other participants, organisers, or staff
HYPD’s decision on all fair play matters is final.
9.4 Prizes
Where prize pools are offered, they will be clearly stated at the time of registration. HYPD reserves the right to withhold prizes where we have reasonable grounds to believe a participant has cheated or breached these terms.
Prize winners are responsible for any applicable taxes on winnings in their jurisdiction.
9.5 Cancellation and changes
HYPD reserves the right to cancel, postpone, or modify events at any time. We will provide as much notice as reasonably possible and will not be liable for any costs incurred by participants as a result of such changes.
9.6 Streaming and recording
By participating in HYPD tournaments and events, you consent to being featured in HYPD’s live streams, recordings, highlights, and promotional content published across our channels.
Brands & Commercial Partners
HYPD works with brands and commercial partners to deliver sponsored content, activations, and events. These partnerships are clearly identified where required by the ASA (Advertising Standards Authority) UK guidelines and the CAP Code.
If you are a brand or business engaging HYPD’s services, a separate commercial agreement will govern that relationship in addition to these terms.
HYPD does not allow advertisers to pay for placement within The Hub community content without appropriate disclosure, in accordance with UK advertising regulations.
Disclaimers
11.1 Platform availability
We aim to keep the HYPD Live website and The Hub available continuously, but we do not guarantee uninterrupted access. We may suspend, modify, or discontinue services at any time for maintenance, updates, or other reasons.
11.2 Content accuracy
We aim to ensure that content on our website is accurate and up to date. However, we make no warranties that the content is complete, accurate, or current. Gaming news, event dates, and community information may change without notice.
11.3 Third-party content
Content sourced from third-party news sites (including thehypdgamer.com and other sources) is reproduced or linked for informational purposes. We do not accept responsibility for the accuracy of third-party content.
11.4 “As is” basis
Our services are provided on an “as is” and “as available” basis without any warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.
Limitation of Liability
This section limits HYPD’s liability to you. Please read it carefully.
To the fullest extent permitted by English law, The Viral Group Ltd (Company No. 12295038, trading as HYPD Live) shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive loss or damage
- Loss of profits, revenue, data, or goodwill
- Loss arising from your reliance on information provided on our platform
- Loss arising from interruption or unavailability of the platform
- Loss or damage caused by viruses or other harmful material that may infect your equipment as a result of using our services
- Any loss or damage arising from third-party actions or content on the platform
Where we are found liable, our total liability to you for all claims shall not exceed £100 (one hundred pounds sterling) or the amount you paid to HYPD in the 12 months preceding the claim, whichever is greater.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.
Your statutory rights as a consumer under UK law are not affected by these terms.
Indemnity
You agree to indemnify, defend, and hold harmless The Viral Group Ltd (Company No. 12295038, trading as HYPD Live), its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the HYPD Live website or The Hub platform
- Any User Content you post or submit
- Your breach of these Terms & Conditions
- Your violation of any applicable law or regulation
- Your infringement of any third party’s rights
Third-Party Services & Links
Our platform integrates with and links to third-party services including Twitch, TikTok, Facebook, Instagram, YouTube, and thehypdgamer.com. These services are governed by their own terms and privacy policies.
HYPD is not responsible for the content, availability, or practices of third-party services. Links to third-party websites do not constitute our endorsement.
The community news feed on the HYPD platform pulls content from thehypdgamer.com via WordPress REST API. That site is a related HYPD property; its content is subject to its own editorial policies.
Suspension & Termination
15.1 By HYPD
HYPD reserves the right to suspend, restrict, or terminate your access to any or all of our services at any time, with or without notice, where we reasonably believe you have:
- Breached these Terms & Conditions
- Engaged in conduct harmful to the community or other users
- Provided false or misleading information at registration
- Engaged in any fraudulent, unlawful, or abusive activity
15.2 By you
You may stop using our services at any time. To delete your Hub account, contact us at enquiries@hypd.live.
15.3 Effect of termination
Upon termination, your right to use the platform ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive termination.
Governing Law & Disputes
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that:
- If you are a consumer resident in Scotland, you may bring proceedings in Scottish courts
- If you are a consumer resident in Northern Ireland, you may bring proceedings in Northern Irish courts
We will always try to resolve any dispute amicably. Please contact us at enquiries@hypd.live before commencing formal proceedings.
As a UK consumer, you also have the right to use the EU/UK Online Dispute Resolution platform for disputes relating to online purchases. However, as HYPD does not currently charge for platform access, this provision is noted for completeness only.
Changes to These Terms
We may update these Terms & Conditions from time to time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this document
- For Hub account holders: send an email notification to your registered address giving at least 30 days’ notice before the changes take effect
- Display a prominent notice on the platform
Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you should stop using our services and, if applicable, delete your account.
